Who sells Givyx

Givyx is sold and run by me, Stanislau Zakharevich, through my sole proprietorship Stanislau Zakharevich TechStream, NIP 8222407798, REGON 528225262, Kraków, Poland. Email: info@givyx.com. I am exempt from VAT, so the prices on the Pricing page are the full amounts you pay.

What these terms cover

These terms apply to givyx.com, to the client panel, and to the plans and one-time services on the Pricing page, which is part of these terms. The contract is made when I confirm by email that I will build your site, and your paid plan starts when I activate it after the free first month.

Givyx is made for small businesses. If you have consumer rights, also read the section about them below. The Free plan you can pick at sign-up is a free account where you can set up and preview a site. It comes with no promise of hosting or publishing the site.

What I do

I design, build, host and keep running a website for your business. AI does much of the work, and I read everything before it goes out. What each plan includes (pages, booking, changes, support, design refresh) is listed on the Pricing page.

A first version to click through is usually ready in a few days, and the site goes live once you approve the copy and photos, usually within two to four weeks. The site runs on a free Givyx subdomain; if you want your own domain, you buy it in your name and I connect it for free. New features are quoted before I build them.

Prices and payment

Plans are paid monthly. The first month is free: you pay from month two, and only if you keep the site. One-time services are paid once, only if you order them, at the price on the Pricing page or in my quote.

I issue invoices through KSeF, without VAT, because I am VAT-exempt. Each month is paid in advance, by bank transfer within 7 days of the invoice. You can also save a card in the panel and pay with it, but you don't have to.

Cancelling

You can cancel any month, and if you don't keep the site after the free month, you owe nothing. To cancel, email info@givyx.com. The cancellation takes effect at the end of the month you have paid for, and I don't refund part months, except when you withdraw under your consumer rights.

If you have consumer rights

If you run a sole proprietorship and the contract with me is not of a professional nature for you, which follows mainly from the business activities in your CEIDG entry, Polish law gives you some consumer rights (Art. 385⁵ of the Civil Code and Art. 38a of the Consumer Rights Act). The same applies if you buy as a consumer.

You can withdraw from the contract within 14 days of making it, without giving a reason, by emailing info@givyx.com. I start work within those 14 days only if you ask me to. If you then withdraw, you pay only for the time used, which is usually nothing, as the first month is free.

Your part

Give me accurate information and only material you have the right to use, such as text, photos and logos. Don't use the site or the panel for anything unlawful, and don't send me unlawful content. To use the panel you need an up-to-date web browser and an email address.

What stays yours

Your text, photos, logo and domain stay yours, and the design I make for your site belongs to you too. The platform your site runs on and my reusable templates stay mine.

Processing your visitors' data

When your site collects data from its visitors (forms, bookings, statistics), you are the controller of that data and I process it for you. This section is our data-processing agreement under Art. 28 GDPR. I process the data only to run your site and as you instruct. I keep it confidential and secure, help you answer your visitors' requests, tell you without undue delay about a data breach, and give you the information you need to check all this.

My sub-processors are Kylos (server in Poland), Microsoft Azure (an EU region), Twilio SendGrid, Google, ImprovMX, OpenRouter and, if you save a card in the panel, Stripe. I tell you by email before adding a new one, and you can object. When the service ends, I delete the data within 30 days, unless the law requires me to keep it.

Ending the service

You can end the service at any time, with effect at the end of the month you have paid for. I can end it by email with 30 days' notice, or at once if an invoice is still unpaid 14 days after a reminder, if the site is used for unlawful content, or if you seriously breach these terms.

Your site stays online until the end of the paid month. If you ask, I send you your text and images within 14 days. I delete the site and its data 30 days after it goes offline. Your domain stays in your name.

Liability

I build and run your site with care, but I can't promise it will always be available or free of errors. My liability is limited to the fees paid in the 3 months before the claim. The limit doesn't apply to damage caused intentionally, or to clients with consumer rights.

Complaints

If something is wrong, email info@givyx.com and describe the problem. I answer a complaint within 14 days, usually within a day.

Law and disputes

Polish law applies to these terms. A dispute with a business client goes to the court for my place of business, Kraków. For clients with consumer rights, the court is set by the general rules.

Changes to these terms

If I change these terms, I update the date at the top and tell clients by email at least 30 days before the change applies to them. You can cancel before it applies. A price change never applies to existing clients.
